Gain In Forum earning system (hereinafter referred to as “PREMIUM PLUS”, “PREMIUM” or the “BASIC”) is the brand name used to describe Gaininforum.com and its services provided to its social network of participating members through content publishing and social network marketing. Guest can either choose to become an independent member or join the premium plus partner program

Congratulations on taking the first step in a journey that could very well change your life. Though it may sound simple, the road ahead will not necessarily be an easy one.

Your success as an GainInForum member or premium plus member will be directly related to the quality of your relationship with your viewers, customers, Affiliates partners and GainInForum. A clear statement of our Policy & Procedures (hereinafter referred to as “P&P”) promotes transparency in partnership to membership, relationships along with transparency from company to affiliates and members. We weigh heavily on treating everyone fair and we ensure that equal opportunity and fairness is available to everyone who makes the choice to enter into the GainInForum world.

As an Independent member, you agree to follow the essence as well as the letter of the P&P. You will find that adhering to the P&P will assist you in providing quality and genuine service, which in return will lead to greater accomplishments and rewards.

GainInForum P&P constitutes part of the Independent Members Agreement and they, when accepted by the Company, together with the GainInForum Compensation Plan and any other document incorporated by reference, that form the Agreement between the Independent member and the Company. The purpose of the Agreement is to authorize an individual to be an Independent Affiliate of the Company and set forth the respective duties, responsibilities and commitments of all parties.

You confirm this agreement each and every time you receive GainInForum points, bonus, rewards, commission payments. It is with great hope of your triumph that we present you this P&P and urge you to adhere to it closely and completely.

Section 1 – CODE OF CONDUCT

First and foremost GainInForum is built on helping the community we believe in honesty and trust and we are working together to achieve a platform that can be seen as transparent and honest. We expect that all members respect and treat the business as such. GainInForum expects all of its members to be of good conduct.

Members to understand the vision and portray GainInForum in the most honest and respectful way. We will not allow any other conduct.

In the essence of mutual respect and understanding, GainInForum is committed to do the following:

a) Provide prompt, professional and courteous service and communications to all of its members/Affiliates and Customers;

b) Provide gainful information’s, Updates, tutorial, Advertisement, tools, resources, and giveaway

c) Provide the highest quality products and services, at fair and reasonable prices;

d) Pay commissions accurately and on a timely basis;

e) Roll out new products, services and programs with members and analysis input and planning;

f) Support, protect and defend the integrity of the GainInForum Business Opportunity;

g) The Company will not guarantee success; GainInForum is here to facilitate you with the tools and resources to help you but not guarantee success.

h) Not to provide any commissions/rewards/bonuses to a suspended user that violates our community guidelines;

i) Not to tolerate pressuring, coercing prospects or down line into purchasing products or services;

j) Offer customers, members, affiliates, partners an opportunity to grow with GainInForum, with such growth guided by the principles of High Quality Leadership.

In return, Gain In Forum expects that its Members & Affiliates will and will not do the following:

a) Conduct themselves in a professional, honest, and considerate manner;

b) Present GainInForum corporate and product information in an accurate and professional manner;

c) Not make exaggerated income claims;

d) Affiliates will Not use Company’s trademarks in any social media platforms;

e) Use the appropriate Independent Logo’s provided for Independent Members or Affiliates;

f) Will not sponsor or enroll minors or persons who are not capable of making an informed decision;

g) Make reasonable efforts to support and train other members and join support Groups

h) Would adhere to taking advantage of the professional writing tools provided by GainInForum to utilize it with their work and strategies, to create high quality contents

Section 2 – PURPOSE OF Gain In Forum

2.1 – Purpose of Policies

GainInForum is a social network and general discussion forum site that fosters great experts, content writers, Q&A seekers, and information driven readers around the globe. To clearly define the relationship that exists between members and GainInForum, and to explicitly set a standard for acceptable business conduct, GainInForum has established these Policies and Procedures

GainInForum Members are required to comply with

(i) All of the Terms and Conditions set forth in which GainInForum may amend in its sole discretion;

(ii) All territorial and local laws governing his or her GainInForum business;

(iii) These Policies and Procedures

GainInForum Affiliates members must review the information in these Policies and Procedures carefully. Should a member have any questions regarding a policy or rule, the member is encouraged to seek an answer from our knowledge base. If further clarification is needed, the Member may contact GainInForum with available contact form or through user tickets.

2.2 – Making Changes, Amendments & Modifications to GainInForum user Accounts/profile

Any such amendment, change, or modification shall be effective immediately:

We Advice members to have all information filed in his/her user profile to be tagged as a valid member and to avoid being suspended/banned in anyway

2.3 – Delays

GainInForum shall not be responsible for delays or failures in performance of its obligations when such failure is due to circumstances beyond its reasonable control. This includes, without limitation, strikes, labor difficulties, transportation difficulties, riot, war, fire, weather, and curtailment of a source of supply.

2.4 – Rights Granted

GainInForum hereby grants to the Independent Members a non-exclusive right, based upon the Terms and Conditions contained in the Independent Agreement and these Policies and Procedures, to:

a) Purchase GainInForum products and services;

b) Publish high quality content that are original and copyright free

c) Share sponsored post to social networks

d) Request for activity withdrawal after meeting the respective criteria

e) Promote GainInForum services and gainful deals

f) Make comments that educates and meets the platform standards

g) Utilize our writing tools in content production

h) To become an affiliate partner to GainInForum services

Section 3 – HOW TO BECOME AN INDEPENDENT MEMBER OR AFFILATE

Firstly you’re required to sign up by buying a membership package, we’ll totally advice that all information’s which are provided by registrants are correct; such as username, email address, date of birth, phone number, and password.

3.1 – Requirements to become an Independent Member

To become an Independent Member or Affiliate, an applicant must comply with the following requirements:

· Must be 16 years of age or the age of majority (not a minor) in his or her country of residence;

· Must be creative and have writing skills

· Submit proper identification on profile and Payment methods

· Must have read through our T&C and P&P.

3.2 – New Independent Affiliate Registration

To become an Independent Affiliate, an applicant must self-enroll.

3.2.1 - Click on the “Register” link on the www.gaininforum.com site;

3.2.2 - Fill out the appropriate fields which are the online registration form, followed by the completion of the personal profile data from their Profile;

3.2.3 - Upon registration, the following information must be given first to create an account: username, email address, password and date of birth.

Coupon code are also required to open an account, such code are purchased through our verified Coupon merchants which can be located on our Buy coupon page.

3.2.4 - Be at least 16 years of age or age of majority in your country of residence;

3.2.5 - Reside in any of the countries that are not listed in our country ‘Banned List’;

3.2.6 - Acceptance of the Terms and Conditions, Member Agreement, and any other legal documents that are legally binding Members which must not be altered, tampered with or changed in any manner after they have been accepted. False or misleading information, forged signatures or alterations to any document, including user registration forms, made after a document has been signed may lead to sanctions, up to and including involuntary termination of their user profile.

The Company reserves the right to reject any applications for a new Affiliate member or Business Profile.

3.3 – Registering an Account as a Business Profile

A corporation, partnership, or trust (collectively referred to as a “Business Profile”) may apply to be a member of GainInForum . This business profile will have access to detailed/advance analysis such as ad related metrics and users are able to create ad campaign and manage their budgets and monitor ad performance.

3.4 Advantage of having a business profile:

a) Advance analysis metrics

b) Business account can create campaign, manage and monitor the performance of their ad;

c) user’s can use the website link button on their profile

A GainInForum business account may change its status under the same account type from a creator to a business account. This changes can be done in account settings.

Section 4 – OPERATING A GainInForum BUSINESS PROFILE.

Having a GainInForum Business Profile is to expand your reach and to promote your brand or services by using our advertising system in reaching out to the audience that suits your business needs.

4.2 – Leadership and Mentorship

· Business/influencers should engage in open communication with their Audience and ensure they pass accurate information about their Business.

· members should monitor and report business account with any inappropriate conduct they notice so as to keep our community safe from spam and fraudulent activities

4.3 – False Registrations

False registrations are strictly and absolutely prohibited. "False Registrations" includes the following:

(a) The enrollment of individuals without their knowledge and agreement;

(b) The fraudulent enrollment of an individual as an Affiliate member;

4.4 – Username Changes

Changing usernames are not permitted under any circumstances. Please when signing up you ensure you have written the correct username that you wish to use on gaininforum.

4.5 – Changes to Password

Member MUST treat their back office and data therein confidentially. The username and password must NOT be disclosed. It is recommended that passwords are changed time to time. GainInForum takes no responsibility for any losses or other problems arising from the Member password getting into the hands of unauthorized third persons.

4.6 – Voluntary Cancellation

A member/affiliate may immediately cancel his or her position by deactivating or closing down account from account settings while logged in, or by submitting a written notice by email to the GainInForum Compliance Department with a registered email address associated with their account. The written notice must include the following:

i) Date of cancellation;

ii) GainInForum Identification Number/username;

iii) Reason for cancelling;

a) Members/Aggregates are free to ask for the termination of their positions, if they wish to end their association with GainInForum. This, however, will result in Member becoming ineligible to receive bonuses and other benefits as their positions will be cancelled.

b) Independent Affiliate Partner who resigns or terminates their Independent Affiliate status may reapply as Independent Affiliate, six (6) months after resignation under their old account.

4.7 – Effect of Termination

Immediately upon termination, the terminated Business Account:

a) Must remove and permanently discontinue the use of the trademarks, service marks, trade names and any signs, labels, stationary or advertising referring to or relating to any product, plan or program of GainInForum;

b) Must cease representing themselves as Independent Business Profile on GainInForum;

c) Loses all rights to his or her account in the Compensation Plan and to all future commissions and earnings;

d) Must take all action reasonably required by GainInForum relating to protection of GainInForum confidential information.

4.8 – Multiple Member /Affiliate /Business Accounts

An individual may be part of only ONE membership /affiliate/business account under his/her name or in a business name.

4.9 – Income Claims and Marketing

Examples of income claims are: ‘MAKE MILLIONS NOW’, ‘QUIT YOUR DAY JOB’, ‘$20,000 INCOME EARNER’ – these are strictly prohibited.

GainInForum has provided marketing material that is considered approved promotional material which is found on our site and your personal back office.

Anyone promoting GainInForum must do so in an honest and truthful manner.

Affiliates are prohibited from creating their own marketing material. All affiliates found to be making income claims will be subject to suspension following termination from our compliance team.

4.9.2 – Using GainInForum Name and Logo All promotional

Materials supplied or created by GainInForum must be used in their original form and cannot be changed, amended or altered except with prior written approval from the GainInForum Compliance Department.

All Members may list themselves as an "Independent Member of GainInForum " on social media. Affiliates must not create social media pages using GainInForum name or official logo.

All materials found to be in breach of any prohibited advertising will result in termination of the Affiliate account. All Affiliate accounts will be suspended and under investigation for a minimum of 30 days until the case is concluded. All questions should be directed to compliance. Please refer to section 4.7

4.10 -Providing Documentation to New Persons

Affiliates must provide the most current version of the Policies and Procedures and the Compensation Plan to individuals whom they are enrolling to become members/Affiliates.

GainInForum wishes to be transparent and we encourage all current enrolled Affiliates/ publishers to help their down-line locate the documents in the back office and on the corporate website.

4.11 – Money Back Guarantee / Cooling Off Period

The Company offers a 7 days, 100% Money Back, and Satisfaction Guarantee to all paid Registered Publisher/members.

The 7 days, 100% Money Back Guarantee, starts from the date of purchase, includes weekends, and only applies to the initial purchase of a paid membership Package, and has not used the Rewards. If a member is dissatisfied with the service for any reason, the member may receive a refund within 7 days of theinitial purchase, for a full refund of the purchased price. All other warranties and guarantees are disclaimed after 7 days, your purchase will no longer be refundable. Please see below for full disclosure:

When you purchase a GainInForum Membership Package, you have a 7-days cooling off period which means that you can regret your purchase and get a refund of your money.

This Cooling off period will be terminated and cancelled immediately if you:

1. Choose to use any of the features on GainInForum website

2. Have used your GainInForum products including but not limited to Membership

3. Use any of the Rewards, coin, and commission in your account

If the above criteria are met, members will neither have a cooling off period nor the right to a refund or a chargeback since you have started to use the product you have bought, which per definition cancels your possibility for any refund and to which the member agree to irrevocably waive their right to a refund. All free account holders can use their back office without any charges or obligations. If they decide not to proceed further by activating their free position they may not be able to take advantage of some of the services of GainInForum.

4.12 Copyright Restrictions

With respect to product purchases from Company, members must abide by all

4.13 Employee Access to Information

GainInForum limits the number of employees who have access to members non-public personal information.

All access is audited and tracked by each of our users/employees for the protection of our Customers and Independent members.

4.14 Restrictions on the Disclosure of Account Information

GainInForum will not share non-public personal information or financial information of our current or former members or Independent Affiliates with third parties, except as permitted or required by laws and regulations, court orders, or to serve the member, or Independent Affiliates’ interests or to enforce its rights or obligations under these Policies and Procedures, or members Agreement or with written permission from the account holder on file.

4.15 – General Provisions

GainInForum has provided all tools ready for you, which facilitate online income through content publishing but not guaranty success as an independent member or affiliate.

4.15 A - Indemnity Agreement

Each and every member agrees to indemnify and hold harmless Company, its shareholders, officers, directors, employees, agents and successors in interestagainst any claim, demand, liability, loss, cost or expense including, but not limited to, court costs and attorneys' fees, asserted against or suffered or incurred by any of them, directly or indirectly arising out of or in any way related to or connected with allegedly or otherwise, the member/affiliate

(a) Activities as Independent Affiliate;

(b) Breach of the terms of the Agreement; and/or

(c) Violation of or allure to comply with any applicable local laws or regulation. GainInForum reserves the right to assume the exclusive defense of any claim for which we are entitled to indemnification under this section. In such event, you shall provide GainInForum with such cooperation as is reasonably requested by GainInForum .

4.15 B- WARRANTIES

Except as expressly stated herein, Company makes no warranty or representation as to the merchantability, fitness for a particular purpose, workmanship or any other warranty concerning any product or service purchased from or through Company.

4.16 C- PROCESSING CHARGES

Company reserves the right to institute a processing charge for aforementioned transfer requests, and/or genealogy requests.

4.17 D - OTHER SERVICES

Independent Affiliates may not promote or sell another company's services at functions organized to feature Company and its products/services. Affiliates are not restricted from selling the services and products of other companies; however promotion of any other companies' services, products and/or business programs which are not listed on the recommended affiliate program, or on the recommendation tab to readers is strictly prohibited.

4.18 E- Enticement

Affiliates may not promote or entice new Affiliates by providing false projections to lure Affiliates to be a part of the GainInForum community. This is grounds for immediate suspension and possible termination.

4.19 F- Poaching

As an Affiliate you are not allowed to promote or try to recruit GainInForum Members and Affiliates to other business, specially, but not limited to, similar online networking/ GainInForum marketing businesses.

5. – REPORTING POST

As a Member of GainInForum, it is important not to converse with any person who places a negative post against you, other Independent members, or GainInForum. Report negative Posts to GainInForum at compliance@gaininforum.com or from the report menu on post. Responding to such negative posts often simply fuels a discussion with someone carrying a grudge that does not hold themselves to the same high standards as GainInForum, and therefore damages the reputation and goodwill of GainInForum.

6. TRADEMARKS

Companies name trademarks, service marks and copyrighted materials are owned by the Company. The use of such marks and materials must be in strict compliance with these Policies and Procedures.

6.1 ADVERTISING & PROMOTIONAL MATERIAL

Only the promotional and advertising materials produced by GainInForum or approved in advance in writing by GainInForum may be used to advertise or promote an Independent Affiliate's business or to sell products and services of GainInForum. GainInForum literature and materials may not be duplicated or reprinted without the prior written permission. Promotional material will be specifically made for the Independent Affiliates to use to promote their businesses. No company logos are allowed on Independent Affiliate promotion sites. All violations will be subject to suspension and possible termination. You are prohibited, without prior written consent by GainInForum, from advertising in any way, shape or form. This includes, but is not limited to advertising, promotions of any kind or any advertising links on social forums, such as but not limited to blogs, social forums or other marketing methodology designed to promote GainInForum free account, paid membership or the possibility to receive GainInForum rewards. GainInForum may offer at some stage, banners or other promotional material together with information about how and where such material may be used. Affiliates may advertise if they are following such guidelines strictly. If the Affiliate fails to comply with these guidelines, GainInForum holds the right to terminate the Affiliate account, including any Rewards attached to the account. Affiliates may not, in any shape or form, create their own advertising or marketing material to promote GainInForum or any of the GainInForum products and services.

6.2 ELECTRONIC ADVERTISING

Independent Members may not advertise or promote their Independent Affiliate business or Company's business, products or marketing plan or use Company's name in any electronic media or transmission, including on the Internet via web sites or otherwise, without the prior written approval of Company's legal and/or Compliance Department. All materials found to be in breach of any prohibited advertising will result in termination of the account. All accounts will be suspended and under investigation for a minimum of 30 days until the case is concluded. All questions should be directed to Compliance.

6.3 TELEPHONE LISTING

Independent Affiliates are not permitted to use Company's trade name in advertising their telephone and telecopy numbers in the white or yellow page sections of the telephone book. Independent Members are not permitted to list their telephone numbers under Company's trade name without first obtaining Company's prior written approval.

6.4 TELEPHONE ANSWERING

Independent Affiliates may not answer the telephone by saying "GainInForum ” or in any other manner that would lead the caller to believe that he or she has reached a corporate representative or the offices of the Company.

6.5 E-MAIL: ELECTRONIC NOTIFICATION

When you are approved as a Member/Affiliate with GainInForum , you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, and communications concerning new products, daily digest, article, giveaway, services, GainInForum commission or other records or correspondence from GainInForum. You consent to receive notices electronically by way of transmitting the notice to you by email using the email address you have registered with GainInForum.

6.6 RECORDINGS

Independent Affiliates may not produce or reproduce for sale or personal use products sold by Company or any Company produced literature, audio or video material, presentations, events or speeches, including conference calls. Video and/or audio taping of Company meetings and conferences is strictly prohibited.

7. MOBILE SERVICES

The web-based platform offered by GainInForum may be available via your mobile phone, including the ability to receive and reply to messages and the ability to browse the GainInForum website and maybe specific application produced for usage and benefit to the Member. GainInForum does not charge you extra for these services, however, your carrier's normal messaging, data and other rates and fees will still apply. You should check with your carrier to find out what plans are available and how much they cost. By accessing and using the GainInForum website via your mobile phone, you agree that we may communicate with you regarding GainInForum, the GainInForum website and other services and products by SMS, Emails, sponsored Ads or other electronic means to your mobile phone and that certain information about your usage of mobile services may be communicated to us. In the event you change or deactivate your mobile phone number, you agree to promptly update your GainInForum membership account information to ensure that your messages are not sent to a person that might have acquired your old number.

7.1. AVAILABILITY, VIRUSES, WARRANTY DISCLAIMER

Due to the nature of the internet and computer systems, GainInForum cannot be held liable for the continuous availability of the website. Although GainInForum makes every Endeavor to keep the website accessible and free from viruses, GainInForum cannot make any guarantee that it is virus free. You shall, for your own protection, take the necessary steps to ensure appropriate security measures and shall utilize a virus scanner before downloading any information, software or documentation. The GainInForum website and services may be unavailable from time to time for maintenance or other reasons. GainInForum assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user communications or content.

GainInForum is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers of any of the before mentioned, computer or mobile phone equipment, software, on account of technical problems or traffic congestion on the internet or at the GainInForum website, including injury or damage to User's or to any other person's computer, cell phone or other hardware or software, related to or resulting from using or downloading materials in connection with the GainInForum website or the crowd funding. All information and services included in or available through the GainInForum website are provided "as is" and "as available" for your personal, non commercial use. Neither GainInForum nor any of its employees, agents, content providers, service providers, or licensors, makes any warranty of any kind regarding the website and/or the content contained therein, the products or services available on or through the website, the results that may be obtained from using the website and/or the products or crowd funding offered through the GainInForum website. GainInForum disclaims all warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. 8. AMENDMENTS

GainInForum reserves the right to amend the Agreement, Policies and Procedures, Terms and Conditions, its retail prices, product and service availability and the Compensation Plan at any time without prior notice as it deems appropriate. By entering into the Member/Affiliate/Business Agreement, a member agrees to abide by all amendments or modifications that Company elects to make. Amendments will be communicated to Member /Affiliate through official Company notifications such as, but not limited to, posting on Company website, posting in Affiliate’s back office, e-mail, special mailings or publications. Amendments are effective and binding upon submission to the Company website. In the event any conflict exists between the original documents or policies and any such amendment, the amendment will control. The continuation of an Independent Affiliate business, the acceptance of any benefits under the Agreement, or acceptance of commissions from the sale of products or services constitutes acceptance of all amendments.
